Services must be designed to meet the needs of all individuals, regardless of their abilities.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The particularities of air and rail transportation<\/h3>\n\n\n\n<p>Air and rail transportation, as well as buses, subways or paratransit, are forms of public transportation. However, they are distinguished by their use primarily for long-distance travel, particularly across large geographic areas such as Qu\u00e9bec or Canada.<\/p>\n\n\n\n<p>All modes of public transit have challenges related to the accessibility of infrastructure, vehicles, information and assistance. However, long-distance travel presents additional challenges due to its length and possible border crossings. These challenges include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Baggage management<\/li>\n\n\n\n<li>Reservations<\/li>\n\n\n\n<li>Boarding and disembarkation procedures<\/li>\n\n\n\n<li>Access to adapted toilets or to food<\/li>\n\n\n\n<li>Intermodality, where passengers find themselves in unknown places<\/li>\n<\/ul>\n\n\n\n<p>The division of responsibilities among the different levels of government in Canada means that accessibility is not always the same between regions. Moreover, the international nature of the standards that govern these industries makes it difficult to implement changes. To ensure true accessibility in air and rail transportation, strong leadership from the authorities is essential. Although consultations were held, the <a href=\"https:\/\/www.oag-bvg.gc.ca\/internet\/English\/att__e_44224.html\">Auditor General of Canada\u2019s report<\/a> highlights several issues, including a lack of staff training, inadequate complaint management and digital accessibility challenges. The shortcomings do not concern the specific obligations or action plans, but rather their implementation. <\/p>\n\n\n\n<p>On the aviation side, the issues are particularly concerning. The media frequently report incidents involving broken or forgotten mobility aids, as well as cases of mistreatment, especially during boarding procedures. The situation has become so critical that a <a href=\"https:\/\/www.canada.ca\/en\/transport-canada\/news\/2024\/05\/ministers-rodriguez-and-khera-hosted-a-national-air-accessibility-summit.html\">National Air Accessibility Summit<\/a> was held in 2024 to address these issues. <\/p>\n\n\n\n<p>In terms of domestic travel in Qu\u00e9bec, airlines and railways are subject to much less stringent obligations than at the federal level. This lack of a rigorous framework results in accessibility gaps that make it difficult for persons with disabilities to travel, even on recently commissioned services. EXO commuter trains, especially on the <a href=\"https:\/\/ici.radio-canada.ca\/nouvelle\/706832\/train-montreal-mascouche-inaccessible\" target=\"_blank\" rel=\"noopener noreferrer\">Montr\u00e9al-Mascouche<\/a> lines , as well as the R\u00e9seau Express M\u00e9tropolitain(REM), are good examples where the needs of persons with disabilities have been neglected. Some are mandatory, while others encourage organizations to go further.<\/p>\n\n\n\r\n<div class=\"accordions-block\">\r\n                    <div class=\"accordion\" data-aos=\"fade-up\">\r\n            <h3 class=\"accordion-title\">\r\n                <a class=\"accordion-link\" role=\"button\" href=\"#panel-accessible-transportation-for-persons-with-disabilities-regulations-atpdr-1\" aria-expanded=\"false\" aria-controls=\"panel-accessible-transportation-for-persons-with-disabilities-regulations-atpdr-1\">Accessible Transportation for Persons with Disabilities Regulations (ATPDR)<\/a>\r\n            <\/h3>\r\n\r\n            <div class=\"accordion-panel\" id=\"panel-accessible-transportation-for-persons-with-disabilities-regulations-atpdr-1\" style=\"display: none;\">\r\n\t\t\t\t<p>Adopted in 2019, after nearly 25 years of changing practices, the ATPDR sets out mandatory requirements for various interprovincial modes of transportation. The requirements cover air, rail, marine and bus transportation, as well as security and border checks. There are administrative monetary penalties for non-compliance.<\/p>\n<p>Two complementary regulations reinforce this legislation :<\/p>\n<ul>\n<li>The <a href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/regulations\/SOR-2021-243\/\">Accessible Transportation Planning and Reporting Regulations<\/a>, which specifies certain obligations.<\/li>\n<li>The <a href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/regulations\/SOR-94-42\/page-1.html\">Personnel Training for the Assistance of Persons with Disabilities Regulations<\/a>, which applies to medium-sized carriers.<\/li>\n<\/ul>\n            <\/div>\r\n        <\/div>\r\n                    <div class=\"accordion\" data-aos=\"fade-up\">\r\n            <h3 class=\"accordion-title\">\r\n                <a class=\"accordion-link\" role=\"button\" href=\"#panel-transit-standards-in-ontario-and-manitoba-2\" aria-expanded=\"false\" aria-controls=\"panel-transit-standards-in-ontario-and-manitoba-2\">Transit standards in Ontario and Manitoba<\/a>\r\n            <\/h3>\r\n\r\n            <div class=\"accordion-panel\" id=\"panel-transit-standards-in-ontario-and-manitoba-2\" style=\"display: none;\">\r\n\t\t\t\t<p>Ontario imposes <a href=\"https:\/\/www.ontario.ca\/laws\/regulation\/110191\">strict accessibility standards<\/a> in public transit, as does Manitoba with its <a href=\"https:\/\/web2.gov.mb.ca\/laws\/regs\/current\/151-2023.php?lang=en\">Accessible Transportation Standard Regulation<\/a>.<\/p>\n            <\/div>\r\n        <\/div>\r\n                    <div class=\"accordion\" data-aos=\"fade-up\">\r\n            <h3 class=\"accordion-title\">\r\n                <a class=\"accordion-link\" the exercise of their rights with a view to achieving social, school and workplace integration(E-20.1)<\/a>\r\n            <\/h3>\r\n\r\n            <div class=\"accordion-panel\" id=\"panel-act-to-secure-handicapped-persons-in-the-exercise-of-their-rights-with-a-view-to-achieving-social-school-and-workplace-integratione-20-1-3\" style=\"display: none;\">\r\n\t\t\t\t<p>In Qu\u00e9bec, section 67 of this act requires public transit authorities to prepare a \u201cdevelopment program for the purpose of providing, within a reasonable period, public transportation for handicapped persons within the territory served by it\u201d.<\/p>\n<p>These regulatory and normative frameworks are essential tools to ensure equitable access to transportation for persons with disabilities, while encouraging organizations to adopt more inclusive and proactive practices.<\/p>\n            <\/div>\r\n        <\/div>\r\n    <\/div>\r\n\n<\/div>\r\n        <\/div>\r\n
